Divorce Financial Remedies

Resolving financial issues can be one of the main concerns for separating couples. There will be many questions arising which relate to what will happen to the matrimonial home, how other assets should be divided, what happens to pension funds and whether maintenance is due to be paid.

It is usually possible to resolve many financial matters through mediation. If a mutually agreed settlement can be reached, then a Consent Order can be drafted which details the agreement made. Both parties sign the document and it is sent to the Court where it is signed by a Judge.

Where agreement cannot be reached, then a formal application to the Court for financial remedy may be necessary. This financial remedy is where a court hearing will decide the issues.
